Consumer Class Actions & Product Counseling

• Successfully excluded a damages expert under Federal Rule of Evidence 702 in a false advertising class action against a multinational restaurant company, resulting in denial of class certification in the Central District of California and affirmance by the Ninth Circuit Court of Appeals.
• Successfully defended a leading manufacturer of oral health products in a class action alleging violations of the CLRA, UCL, and False Advertising Law, as well as warranty, fraud, and negligent misrepresentation claims, securing dismissal of all claims and sanctions against plaintiffs’ counsel.
• Defended a hair and skin care company against threatened claims under the CLRA and other California consumer protection statutes, resulting in withdrawal of the claims without litigation or payment.
• Advising a biotechnology company through the launch of its skin care line, including claims substantiation, marketing strategy, MoCRA compliance, and mitigation of consumer class action and regulatory risk.
• Successfully resolved nationwide class actions against personal care manufacturers involving: “natural” claims; allegations of benzene in dry shampoo products;  
• Counseling clients on “Made in USA” and other US-origin claims; sustainability and environmental marketing claims; MoCRA compliance; product labeling and packaging; website design; and marketing strategy.
• Routinely defending companies, including personal care product businesses, in Proposition 65 matters and leveraging experience with private enforcers and their counsel to negotiate prompt, efficient, and favorable resolutions.

Product Liability

• Representing a global manufacturer and distributor of prestige fragrances and cosmetics in consumer class actions and product liability litigation, including talc-litigation. 
• Representing a manufacturer and distributor of a recalled household consumer product in multiple wrongful death and product liability cases alleging bacterial contamination.
• Representing a global medical device manufacturer in product liability and related litigation involving orthopedic implants, surgical instruments, power tools, emergency medical supplies, bone morphogenetic proteins, and other medical technologies.
• Served on national coordinating and lead trial counsel teams for manufacturer in major medical device mass torts involving implantable orthopedic devices and pain management systems.
• Served as a key member of California trial teams for a pharmaceutical manufacturer in mass product liability litigation concerning the voluntary withdrawal of a nonsteroidal anti-inflammatory drug and helped coordinate and manage thousands of related lawsuits.
• Provided pre-market advice to a leading medical device company concerning new cardiac implant technology, including risk assessment and recommendations regarding product literature, launch materials, and training intended to reduce product liability exposure.
• Defended supplier of sophisticated ventilation and air-handling systems in a case arising from the death of a hospital employee while servicing the equipment, including related indemnity and apportionment claims.

Complex Litigation

• Leading arguments on novel issues under Section 230 of the Communications Decency Act as well as personal jurisdiction in high-profile class actions asserting claims under the Trafficking Victims Protection Reauthorization Act (TVPRA).
• Representing a Canadian-based medical technology company developing AI-powered MRI-guided therapies in a complex commercial dispute.
• Defending several prominent Beverly Hills spine surgeons in False Claims Act litigation in the Central District of California, currently on appeal before the Ninth Circuit.
• Serving as outside general counsel to a Beverly Hills medical surgery center, advising on litigation matters, contracts, and related business issues.
• Defended a top global toy manufacturer in multiple intellectual property matters, including patent cases in the Western District of Texas.
• Served as interim general counsel for a Los Angeles-based real estate investment and property management firm, managing a large litigation docket and helping design a case-management system.
